Terms and Conditions for Rebate
 

The Buyer Brokerage Agreement and Rebate Program Terms and Conditions must be completed, signed and returned before any rebate will be issued.

Rebate is available only to buyers who close with House Plan Realty, LLC acting as their exclusive agent in the purchase of real estate in the Charleston, South Carolina area. For new construction homes with a final price of $100,000 or more, the rebate is 1.5% of the closing contract price net of any allowances or other deductions by House Plan Realty, LLC related to the transaction. For resale homes with a final sales price of $100,000 or more, the rebate is 1.0% of the closing contract price net of any allowances or other deductions by House Plan Realty, LLC related to the transaction. Rebates are not available for homes with a sales price (final contract price) of under $100,000. Rebate is conditional on selling broker receiving a minimum of 3% commission on the purchase of the home. Bonuses or other compensation are not considered a part of the commission for purposes of this requirement and are not included in any rebate.

 

This rebate is available for standard home purchases but is not available on the purchase of “short sale” properties or for the purchase of lender owned properties due to the significant addition of agent time and resources usually associated with these purchases.  

In the event that a referral fee or commission must be paid on the sale of a property reducing the amount of commission received, the rebate would be reduced directly by the amount of the referral fee or commission.

This rebate is only available on homes purchased in the Greater Charleston South Carolina Area that are listed on the Charleston Trident Association of Realtors Multiple Listing Service. Because this is a reduction of commission earned, individual agents for House Plan Realty, LLC have an option of not participating in this rebate program. You must register for the rebate in advance to ensure you are working with an agent who participates in this rebate program. House Plan Realty, LLC agents may participate in this rebate program but are not required to participate. Ask your agent to be sure you are eligible. Failure to register or to sign the Buyer Brokerage Agreement and Rebate Program Terms and Conditions will result in your not receiving a rebate.

Any rebate from House Plan Realty, LLC must be fully disclosed to the buyer's lender(s) by the buyer and cannot be given if it is otherwise prohibited by the buyer's lender(s). It is the buyers’ responsibility to verify that the lender(s) will allow this rebate.

Buyer Brokerage Agreement must be for a minimum of 6 months.


Rebate will appear on the HUD 1 closing statement. The rebate will be paid only to the party or parties named as the "buyer(s)" or "borrower(s)" on the HUD-1 Closing Statement or equivalent official closing statement and cannot be disbursed to a third party. Buyer(s) must complete a W-9 form prior to closing as a 1099 form will be issued when appropriate and as required by law.

This rebate is available to homeowners who assist in the search for their new home and thereby reduce the costs incurred by their agent. In order for the buyer to be eligible for the rebate, House Plan Realty, LLC will not show more than 10 homes during the term of the exclusive buyer agency agreement. Rebate applies only to one home purchase attempt. Purchase negotiations on subsequent home(s) (such as when no contract is reached on the first home so the buyer makes offer(s) on another home(s)) do not qualify for any rebate due to the added time and resources required by your agent. Of course, buyers can search for and view an unlimited number of homes online to narrow down the list of homes they wish to be shown by an agent. Again, the purpose of the rebate is to reward buyers for being active and focused in their search thereby reducing overall costs to their agent.

Should the seller and/or listing broker in a transaction offer the broker representing the buyer a bonus or other additional incentive over and above a cooperating brokerage commission, then any such bonuses or other additional incentives are separate and apart from the cooperating brokerage commission actually received by House Plan Realty, LLC and the buyer is not entitled to a rebate on any bonus or other additional incentive monies paid to House Plan Realty, LLC over and above the cooperative broker commission.
